The company under the name “COSMOTE PAYMENTS - E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME” (hereinafter “COSMOTE Payments” or the “Organiser”), having its headquarters in 151 24 Maroussi, Attica, (Kifissias Avenue, 99), is organising, in collaboration with “Deutsche Telekom AG” (hereinafter the “Company”), having its headquarters in Bonn, Germany (Friedrich-Ebert-Allee 140, D-53113 Bonn), and “DeTeFleet Services GmbH” (hereinafter the “Partner”), having its headquarters in Bonn, Germany (Friedrich-Ebert-Allee 140, D-53113 Bonn) the “10% payzy ride delight cashback in Germany” promotional action (hereinafter “Promo”), addressing to COSMOTE Payments’ card holders for purchases in the app “goodride” by DeTeFleet Services.
The purpose of these terms (hereinafter “Terms”) is to define the terms of participation in the Promo.
1. All permanent residents of Germany, qualified for legal acts, who are at least 18 years old, hold a personal payments account at COSMOTE Payments and are holders of the virtual payzy VISA debit card (hereinafter “Card”) that is connected to the aforementioned payments account (hereinafter the “Participant(s)”) are eligible to participate in the Promo.
2. The Promo starts from 01/10/2024, at 00:00:01 and lasts at most until 31/12/2024, at 23:59:59.
3. The Promo is exclusively valid for purchases in the app “goodride” of the Partner using the Card.
4. COSMOTE Payments reserves the right to discontinue or extend the duration of the Promo by notifying Participants in any appropriate manner (e.g. announcement on the website, notification in the app, etc).
5. Participants shall receive a sum of money in their payment account held at COSMOTE Payments (“Cashback”), which corresponds to 10% of the final value of the transaction, which has been paid using the Card, until a maximum amount of 5 EUR per transaction and Participant’s account.
6. The Promo applies to transactions that are carried out, within this duration, directly and wholly using the Card (tokenized on Participant’s smartphone) in the Partner’s app and not in any other way.
7. The Participant, in the context of the “Coins” Loyalty Programme, which is described on the Terms of Use of the “payzy” app, will collect as many Coins as the amount of the money that has been paid using the Card and which equal to an additional 1% redemption in Euros to their payments account at COSMOTE Payments.
8. Once the payment transaction carried out with the Card has been settled, the Cashback will be credited on the payments account of the Participant.
9. COSMOTE Payments shall bear no liability towards the Participants and/or any third party for any damages (direct or indirect, special etc), costs and expenses that may arise from any interruption, malfunction, delay or any other cause related to the implementation of the Promo.
10. COSMOTE Payments is liable solely for the deposit of the Cashback. COSMOTE Payments bears no further liability, nor is it involved in or does intervene in any problem that may arise regarding the Partner’s products, for which the latter is solely liable.
11. The data controller is the Organiser, namely ‘COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER SOCIÉTÉ ANONYME’, with its headquarters in 151 24 Maroussi, Attica, (No 99 Kifissias Avenue).
The following personal data of the Participants shall be collected and processed in order to participate in the Promo:
- The details of the Card used in the payment transaction.
- The date and time of execution of the payment transaction.
- The total amount paid using the Card.
- COSMOTE Payments’ payment account number.
12. The data is collected for the purpose of carrying out the Promo in accordance with these Terms and to serve the contract concluded between the Participant and COSMOTE Payments, based on which the Participant maintains a payment account with COSMOTE Payments and lawfully hold a Card or Cards that are connected to the above payment account and use the Card or Cards as a means of payment, in accordance with the terms of the General Information regarding Personal Data Protection, that you can find here. Under these terms, the personal data collected are retained for a period of five (5) years from the date of execution of the payment transaction. Upon expiry of this deadline, the data shall be deleted, unless another provision of law or regulatory act requires them to be stored for a longer period, which cannot exceed ten (10) years (e.g. for tax purposes).
The following third companies are also recipients of the Participants’ personal data:
- NEXI GREECE PROCESSING SERVICES SINGLE-MEMBER S.A., which provides payment processing and card issuing services and has its registered office in Greece.
- NETCOMPANY-INTRASOFT S.A., which provides and supports the operation of COSMOTE Payments' banking systems and has its registered office in Greece.
- COGNITY S.A., which supports the operation of the payzy application and has its registered office in Greece.
These third-party companies are processors on behalf of COSMOTE Payments – in other words, they are partners of COSMOTE Payments – who undertake the execution of a specific project following the instructions of COSMOTE Payments and applying the strict procedures of the OTE Group regarding the processing of the Participants’ personal data. COSMOTE Payments remains liable with regard to the processing of personal data carried out by its partners. The processing of the Participants’ personal data for the above purposes by COSMOTE Payments’ partners takes place within the European Union (EU), specifically in Greece and, under circumstances, in Germany.
13. Beyond the above-mentioned companies, COSMOTE Payments does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable laws.
14. Participants have the following rights regarding the processing of their personal data:
• Right of access: the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
• Right to rectification: the right to request the correction of their data (e.g. correction of contact details).
• Right to erasure: the right to request the deletion of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
• Right to restriction of processing: the right to request the restriction of processing for a specific purpose.
• Right to object to processing of their personal data in cases in which they do not want their personal data to be processed.
15. The Organiser has appointed a Data Privacy Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, Participants may send an e-mail to customerprivacy@cosmotepayments.gr.
In order to exercise their rights, Participants may send:
a. an e-mail to customerprivacy@cosmotepayments.gr, or
b. a fax to +30 2102511888 or
c. a letter to COSMOTE Payments Customer Service, No 99 Kifissias Ave., GR-151 24, Maroussi, regarding ‘Exercising of Personal Data Rights’, stating their full name and their mobile telephone or landline connection number.
16. Participants reserve the right to lodge a complaint, via a special web portal, with the Hellenic Data Protection Authority (Athens, Nos 1-3 Kifissias Avenue, GR-115 23 | tel. No +30 210 6475600). The Organiser shall respond to the requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months, if the complexity of the request so requires. In any case, the Organiser shall make notification regarding this extension and the reason for the delay. If it is found that the request is clearly unfounded or excessive, the Organiser reserves the right to request payment of a reasonable fee to its satisfaction, taking into account the administrative costs for its execution or even to refuse to follow up the request.
17. The Organiser shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access and any other form of unlawful processing.
18. The Organiser shall not be liable for leaks of the Participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
19. During the Promo, the Organiser reserves the right to amend and/or revoke it, change the dates on which it will be held or any other of its Terms, change or amend the percentage of Cashback and its method of payment, informing Participants by any appropriate means (e.g. by e-mail or push notification or text message).
20. Participation in the Promo requires and implies the explicit and unreserved acceptance of all these Terms.
21. These Terms are governed by Greek law without prejudice to mandatory legal provisions of the German consumer legislation. Any dispute as to their interpretation and/or application shall be resolved by the courts of the place where the Participant is domiciled.
