"One Year of payzy" Cashback Prize Draw in Germany
The company under the name “COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER S.A.” (hereinafter “COSMOTE Payments” or the “Organiser”), having its headquarters in 151 24 Maroussi, Attica, (99 Kifissias Avenue), is organising, in cooperation with “Deutsche Telekom AG”, having its headquarters in Bonn, Germany (Friedrich-Ebert-Allee 140, D-53113 Bonn), the “One Year of payzy” Cashback Prize Draw promotional action (hereinafter “Promo”), addressing COSMOTE Payments’ card holders in Germany for purchases in shops and online.
The purpose of these terms (hereinafter “Terms”) is to define the terms of participation in the Promo.
1. All permanent residents of Germany, qualified for legal acts, who are at least 18 years old, hold a personal payments account at COSMOTE Payments and are holders of the virtual payzy Visa debit card (hereinafter “Card”) that is connected to the aforementioned payments account (hereinafter the “Participant(s)”) and consent to the participation Terms by actively clicking on the button “Participate” within the payzy app (in the sub-menu “Earn with payzy”) are eligible to participate in the Promo. Employees of Cosmote Payments and DT Fintech team are not eligible to participate in the Promo.
2. The Promo starts from 02/04/2025, at 00:00:01 and lasts until 30/06/2025, at 23:59:59 (hereinafter the “Duration”).
3. The Promo is valid exclusively for any transaction in shops or online using the Card, excluding any money transfer transactions (e.g. top up other accounts or wallets or betting accounts, Account-to-Account transactions as Chat & Pay or Split it, investment transactions, SEPA transfers etc).
4. The Promo applies to transactions that are carried out, within the Duration, directly and wholly using the Card (tokenized on Participant’s mobile phone) at the merchant’s physical or virtual POS and not in any other way. Furthermore, the Promo applies to transactions that have been cleared and settled by the expiry of the Duration, and that have not been rejected or disputed. Any transaction completed after the Duration, will be considered non-existent and will not be taken into consideration by the Organizer either for the eligibility of the Participant or for the Cashback estimation.
5. Participants who perform at least one purchase in shops or online using the Card in a given month (April 2025, May 2025, or June 2025), will be eligible for the monthly "One Year of payzy" Cashback Prize Draw. Each month (i.e. on May 13th for April winners, on June 11th for May winners and on July 11th for June winners), COSMOTE Payments will draw fifty (50) winners who receive cashback (hereinafter “Cashback”) to their entire settled and cleared Card transaction volume of that month as outlined below (para. 7). Each Participant is eligible to only one Cashback prize per month. The draw will be held by COSMOTE Payments monthly (on the afore-mentioned dates) using electronic means, which ensure the randomness of the selection and the integrity of the process. If for any reason, it is impossible to conduct the selection on the afore-mentioned dates, the Organizer reserves the right to modify the day of the selection by informing the Participants in any way the former deems appropriate.
6. All eligible Participants who have completed at least one settled and cleared transaction during a certain month of the Duration, have equal chance to winning a Cashback prize of this month, irrespectively of the total number of such completed transactions.
7. The Cashback prizes of the Promo offered each month are as follows:
• 5 x 100% Cashback: the five (5) winners of the first category shall receive a sum of money in their payments account held at COSMOTE Payments, which corresponds to 100% of the final value of all their transactions executed using the Card in this particular month until the amount reaches the maximum sum of one thousand euros (€1000).
• 10 x 50% Cashback: the ten (10) winners of the second category shall receive a sum of money in their payments account held at COSMOTE Payments, which corresponds to 50% of the final value of all their transactions executed using the Card in this particular month, until the amount reaches the maximum sum of five hundred euros (€500).
• 35 x 25% Cashback: the thirty-five (35) winners of the third category shall receive a sum of money in their payments account held at COSMOTE Payments, which corresponds to 25% of the final value of all their transactions executed using the Card in this particular month, until the amount reaches the maximum sum of two hundred and fifty euros (€250).
For the avoidance of any doubt, any refunds credited to Participants’ accounts shall not be taken into consideration when determining the final value of the transactions.
For the calculation of the Cashback, the Organiser will take into account card transactions that have been cleared on the day before each monthly prize draw (i.e. on May 12th for April participants, on June 10th for May participants, and on July 10th for June participants).
It is clarified that in any case, any tax imposed by the Greek State on prizes remains the responsibility of the prize winner and is determined according to the provisions set forth in the applicable legislation.
8. Additionally, each Participant, in the context of the “Coins” Loyalty Programme, which is described on the Terms of Use of the “payzy” app, will collect as many Coins as the amount of the money that has been paid using the Card and which equal to an additional 1% redemption in Euros to their payments account at COSMOTE Payments.
9. COSMOTE Payments shall bear no liability towards the Participants and/or any third party for any damages (direct or indirect, special etc), costs and expenses that may arise from any interruption, malfunction, delay or any other cause related to the implementation of the Promo.
10. COSMOTE Payments is liable solely for the deposit of the Cashback and bears no further liability.
11. The data controller is the Organiser, namely ‘COSMOTE PAYMENTS – E-MONEY SERVICES SINGLE-MEMBER S.A.’, with its headquarters in 151 24 Maroussi, Attica, (99 Kifissias Avenue).
The following personal data of the Participants shall be collected and processed in order to participate in the Promo:
- The details of the Card used in the payment transaction.
- The date and time of execution of each payment transaction.
- The total amount paid using the Card (per transaction and per month).
- COSMOTE Payments’ payment account number.
- The amount of Cashback received in case of win.
COSMOTE Payments shall hold the right to communicate the result of this Promo and the prize draw in owned marketing channels for the purpose of ensuring the Promo transparency, without explicitly exposing customer data. More specifically, by accepting their participation to this prize draw, the Participants agree that, in case they win, their name will be published by the Organizer in a way that their exact identification will not be possible.
Also, the Participants agree that in case of winning, the Organizer will contact them by email to inform them of their win.
12. The data is collected for the purpose of carrying out the Promo in accordance with these Terms and to serve the contract concluded between the Participant and COSMOTE Payments, based on which the Participant maintains a payment account with COSMOTE Payments and lawfully hold a Card or Cards that are connected to the above payment account and use the Card or Cards as a means of payment, in accordance with the terms of the General Information regarding Personal Data Protection, that you can find here. Under these terms, the personal data collected are retained for a period of five (5) years from the date of execution of the payment transaction. Upon expiry of this deadline, the data shall be deleted, unless another provision of law or regulatory act requires them to be stored for a longer period, which cannot exceed ten (10) years (e.g. for tax purposes).
The following third companies are also recipients of the Participants’ personal data:
- NEXI GREECE PROCESSING SERVICES SINGLE-MEMBER S.A., which provides payment processing and card issuing services and has its registered office in Greece.
- NETCOMPANY-INTRASOFT S.A., which provides and supports the operation of COSMOTE Payments' banking systems and has its registered office in Greece.
- COGNITY S.A., which supports the operation of the payzy application and has its registered office in Greece.
These third-party companies are processors on behalf of COSMOTE Payments – in other words, they are partners of COSMOTE Payments – who undertake the execution of a specific project following the instructions of COSMOTE Payments and applying the strict procedures of the OTE Group regarding the processing of the Participants’ personal data. COSMOTE Payments remains liable with regard to the processing of personal data carried out by its partners. The processing of the Participants’ personal data for the above purposes by COSMOTE Payments’ partners takes place within the European Union (EU), specifically in Greece and, under circumstances, in Germany.
13. Beyond the above-mentioned companies, COSMOTE Payments does not process or disclose personal data to third parties, with the exception of cases where their communication/transmission is required by the applicable laws, or is essential for the purpose of processing as described above (para. 12).
14. Participants have the following rights regarding the processing of their personal data:
• Right of access: the right to receive information about the personal data subject to processing (e.g. the purposes of processing, the types of data, the recipients to whom they are communicated, the period for which they are retained) and to be provided copies thereof.
• Right to rectification: the right to request the correction of their data (e.g. correction of contact details).
• Right to erasure: the right to request the deletion of their personal data if they are no longer necessary in relation to the purposes for which they were processed or if they withdraw their consent.
• Right to restriction of processing: the right to request the restriction of processing for a specific purpose.
• Right to object to processing of their personal data in cases in which they do not want their personal data to be processed.
- Right to data portability: the right to request the transfer of data to another data controller.
15. The Organiser has appointed a Data Privacy Officer (DPO) based on the provisions of the applicable legislation. To contact the Data Protection Officer, Participants may send an e-mail to customerprivacy@cosmotepayments.gr.
In order to exercise their rights, Participants may send:
a. an e-mail to customerprivacy@cosmotepayments.gr, or
b. a fax to +30 2102511888 or
c. a letter to COSMOTE Payments Customer Service, No 99 Kifissias Ave., GR-151 24, Maroussi, regarding ‘Exercising of Personal Data Rights’, stating their full name and their mobile telephone or landline connection number.
16. Participants reserve the right to lodge a complaint, via a special web portal, with the Hellenic Data Protection Authority (Athens, Nos 1-3 Kifissias Avenue, GR-115 23 | tel. no +30 210 6475600). The Organiser shall respond to the requests free of charge without delay, within one (1) month from the receipt of the request. In exceptional cases, this deadline may be extended by two (2) months, if the complexity of the request so requires. In any case, the Organiser shall make notification regarding this extension and the reason for the delay. If it is found that the request is clearly unfounded or excessive, the Organiser reserves the right to request payment of a reasonable fee to its satisfaction, taking into account the administrative costs for its execution or even to refuse to follow up the request.
17. The Organiser shall take appropriate organisational and technical measures to secure the data and protect them from accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access and any other form of unlawful processing.
18. The Organiser shall not be liable for leaks of the Participants’ personal data due to their disclosure of any of their data via third-party or other internet sites.
19. The Terms remain valid for the Participants also after conclusion of the Promo and as long as the right of access persist to the content pursuant to the above mentioned Terms.
20. During the Promo, the Organiser reserves the right to amend and/or revoke it, discontinue or extend the Duration of the Promo, change the dates on which it will be held or any other of its Terms, change or amend the percentage of Cashback the maximum sums and the details of the prizes categories of para. 7, the method of payment, etc., informing Participants by any appropriate means (e.g. by announcement on the website, e-mail or push notification or text message). Participation in the Promo carried out online, requires access to the internet and the Payzy app by the Participants using their own technical means. The Organizer assumes no responsibility for ensuring or assisting with access to internet services or providing any facilities to any participant.
21. The Participant acknowledges that each Prize Draw is final, and, thus, not subject to any contestation or legal recourse.
22. Participation in the Promo requires and implies the explicit and unreserved acceptance of all these Terms. In case that a Participant does not fulfill the criteria stated in these terms or does not comply with them or the applicable legislation, the Organizer reserves the right at its sole discretion to exclude them from the Promo, in any stage of it, even after the winners’ selection.
23. These Terms are governed by Greek law without prejudice to mandatory legal provisions of the German consumer legislation. Any dispute as to their interpretation and/or application shall be resolved by the courts of Athens.
